A trademark registered in India is valid for ten years, counted from the date of the application. Trademark renewal extends it for another ten years each time, with no limit on how often you renew.
The renewal is filed with the Trade Marks Registry in Form TM-R by the registered owner or their agent. If it is not renewed, the mark can be removed from the register.
| When | What you can do |
|---|---|
| Up to one year before expiry | File Form TM-R with the renewal fee. This is the best time to renew. |
| Up to six months after expiry | Renew with Form TM-R and a surcharge on top of the renewal fee. |
| After six months, up to one year from expiry | If the mark has been removed, apply for restoration and renewal. The Registrar decides. |
| More than one year after expiry | Restoration is no longer available. A new trademark application is usually the only route. |
Government fees are extra and depend on the stage and the number of classes. We confirm them before filing.
If the six-month window has passed and the mark has been removed for non-renewal, the owner can apply for restoration and renewal in Form TM-R, within one year from expiry.
Restoration is not automatic. The Registrar considers whether it is fair to restore the mark, including the interests of anyone who has since adopted a similar mark.
If the owner's name, address or the business that owns the mark has changed since registration, the record should be updated before or with the renewal.
Share your trademark number and the expiry date, if you know it.
We check the mark's status and stage on the IP India records and confirm the fees.
We prepare the renewal, surcharge or restoration request for the right stage.
We file it with the Trade Marks Registry and track it until the renewal is recorded.
The Registrar can remove the mark from the register and publish the removal.
Without a live registration, enforcing your rights against copycats is harder.
Someone else may apply for a similar mark once yours is off the register.
Surcharge and restoration fees add up, and after one year you start again.
